These Terms & Conditions (“Terms”) set out the basis on which [Farrar & Forbes] (“we,” “our,” or “us”) provide estate agency services, including residential and commercial sales, lettings and property management, to our clients (“you” or “your”).
By engaging our services, you agree to these Terms.
1. Our Services
We provide estate agency services including but not limited to:
Marketing and sale of residential and commercial properties
Letting and property management services
Tenant referencing and checks
Advice on property values, rental yields and marketing strategies
2. Fees and Payment
Our fees will be agreed in writing before work commences
Fees for sales are typically calculated as a percentage of the final selling price, subject to VAT
Fees for lettings and management may include:
Letting commission (percentage of rent)
Management fees (percentage of rent or fixed fee)
Additional charges for services such as inventory, inspections or legal notices
Payment terms will be set out in our engagement agreement
We reserve the right to charge interest on overdue amounts in accordance with the Late Payment of Commercial Debts (Interest) Act 1998
3. Client Responsibilities
You agree to:
Provide accurate and complete information about the property
Ensure you have the legal right to sell, let or manage the property
Comply with all legal and regulatory obligations, including but not limited to:
Gas and electrical safety checks
Energy Performance Certificates (EPCs)
Right to Rent checks
Anti-Money Laundering (AML) requirements
Promptly provide any documentation or access required for us to perform our services
4. Our Responsibilities
We will:
Market your property using appropriate channels
Carry out reasonable due diligence on potential buyers or tenants
Manage offers and negotiations in your best interest
Handle client money in compliance with [Client Money Protection & Redress Scheme]
Comply with relevant legislation including the Estate Agents Act 1979, the Consumer Protection from Unfair Trading Regulations 2008
5. Liability
We will perform our services with reasonable skill and care
We are not liable for:
Losses caused by inaccurate information provided by you
Market conditions affecting property value or rental income
Acts or omissions of third parties (e.g., solicitors, surveyors, contractors and referencing agencies)
Our liability is limited to the total fees paid by you for the relevant service, except where liability cannot be excluded by law
6. Termination
You may terminate our agreement in writing at any time, subject to any notice period specified in our engagement agreement
We may terminate this agreement if:
You breach these Terms
You fail to pay fees when due
Continuing to act for you would breach our legal or regulatory obligations
7. Data Protection
We process personal data in accordance with our Privacy Policy.
8. Complaints
We are committed to providing a high standard of service. If you are dissatisfied, please follow our Complaints Procedure.
If your complaint is not resolved, you may refer it to [RedProperty Redress Scheme].
9. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
